Of predictions, bias and opinions

I know, I know, I am not a law professor. But the new essay about liberal law professors and the anti-mandate argument in the Obamacare cases, cited here, has me wondering whether one can really say one is biased because one predicts something and the opposite occurs. Maybe yes, maybe no. It depends upon the circumstances and what is being said, and what is being predicted, as Andrew Koppelman, a liberal minded law prof from Northwestern University law school, wrote in the first linked post. While I haven't read David Hyman's essay castigating liberal law professors and their supposed herd mentality, I would like to take myself as an analogy to a law professor. I wrote a post early in the litigation against Obamacare ripping into Ilya Solmin's anti-insurance mandate arguments, but then agreed with him that despite my finding his anti-mandate arguments to be ridiculous, I believed the Obamacare case was going to be a 5-4 decision at the Supreme Court level. Initially, I thought Justice Kennedy was going to reject the anti-mandate arguments and join with the not-conservatives (Kagan, Ginsburg, Breyer and Sotomayor). Then, right after oral arguments on the Obamacare case in March 2012, I began to change my mind about the state of mind of Justice Kennedy. I began to openly wonder if the mandate would be struck down as Justice Kennedy joined the Four Horsemen of the Conservative Apocalypse. See here. I believed then the anti-mandate arguments were silly, and I believe that now (I don't like the mandate policy from a policy making standpoint, as I'd rather see Medicare for All. I do, however, believe it is eminently constitutional.). However, politically, I was always ready to concede we live in silly times and that the US Supreme Court consists of justices who are part of the silliness--and therefore at least four of the Supreme Court justices would take seriously the anti-mandate arguments. It turned out to be five...That's a bias I suppose. But I stand by my opinion on the lack of merits of the anti-mandate arguments. And I look pretty good in my predictions, though not perfect by any means. For example, most people, whether law professors or political commentators, did not see the Chief Justice Roberts "pro-tax argument to uphold Obamacare" coming down the legal pike...Notwithstanding the above, if some liberal law professor predicted all nine Justices would vote to uphold the insurance mandate as constitutional, I'd say that person gets the Dick Morris Award.

You're the GM of series....my second round results

Continuing the "You're the GM..." theme, I'm going to do a quick write up of what I'd do in the second round (this is based on the Draft Re-Do)33. New England Patriots (acquired by trading down with Jacksonville) - CB Jamar Taylor (first round pick - none)New England needs corners and Jamar Taylor is watching his stock skyrocket right now.  He one of the most complete corners in the draft and should be a day one starter.34. San Francisco 49ers - DE Margus Hunt (first round pick - NT John Jenkins)At 6'8", Hunt is not only a huge obstacle for quarterbacks to throw over, but for kickers to avoid as well.  In college, he earned his nickname, "The Eastern Block" by blocking a total of 17 kicks.  He's one of the top athletes in the draft who had one of the best Combines in recent memory and will upgrade the defensive end position immediately.  Drafting him along with my first round choice of Jenkins gives the Niners a young core of players on the defensive line.35. Miami Dolphins (acquired by trading up with Philadelphia) - OT Menelik Watson (first round pick - DE Bjoern Werner)Miami still needs to fill the hole left by Jake long.  They use some of the fire power they have in this draft (their first of two second round picks and a third) to move up and secure Watson who is climbing boards,  I wouldn't be surprised at all if he goes in the first round, but in this mock he's here and the Dolphins make a big move to land him before the tackle-starved Lions and Cardinals.36. Detroit Lions - OT Terron Armstead (first round pick - CB Dee Milliner)The Lions would have to choose between Cornellius Carradine and an offensive tackle.  The top two left are Armstead and Justin Pugh and I took Armstead because of his upside.  He's probably my favorite small-school player in this draft and one of my favorites all-around.  His huge upside and unbelievable toughness make him my clear choice for the Lions.37. Cincinnati Bengals - DE Cornellius Carradine (first round pick - S Kenny Vaccaro)Defensive end Michael Johnson is currently franchised by the Bengals and by selecting Carradine, they have his replacement in 2014.  Carradine is coming off a major knee injury and is not expected to be ready for week one, but with Johnson locked up for one year, the Bengals can afford to let this first round talent heal up before leaning on him.The rest of the second round, after the jump...Read more »Fantasy Football Trenches - Where The Game Is Won

Vikings Head Coach Leslie Frazier

On January 3, 2011, the Vikings and Leslie Frazier reached an agreement making him the permanent head coach. In his first season as head coach, the rebuilding Vikings went 3–13, their worst season since 1984. On December 5, 2011, Vikings owner Zygi Wilf stated Frazier would return in 2012. In Frazier's second full year as head coach, the Vikings improved to 10-6, making the playoffs. The biggest single-season turn around in Vikings history resulted in Leslie Frazier finishing fourth in voting for the NFL Coach of the Year Award and the Vikings exercising their fourth year team option to keep Frazier under contract through 2014.

Pacific Inferno

Hey sorry about the delay everyone I know you have been dying to see our faces / hear our wonderful voices talking about all things video gamey and what  not but. With all of our crazy schedules we kinda forgot to post this shizz.  So here it is our second video game podcast. This one is a little different we tried a more free flow no host type pod cast where everyone could just talk about whatever. Strangely enough this is probably one of the shortest ones we ever did. It's about one hour and eleven minutes of pure madness. Or relatively calm chaotic discussion.  Matt, Ray, Nick, Mike and myself showcase our gift of gab in : UNDERRATED HEROES PODCAST#2 - THE SEARCH FOR MORE FACAIL HAIR... What I thought it was funny at the time.

Mesa Grand Prix Finals Day 3Last day of competition at Mesa Grand Prix has come. We are getting a little bit emotional because no more days of see Conor and Ryan looking great in those glorious tiny and colorful speedos left so we will be waiting for the next one. For now this is our last blog about the meet, and just like in past two days here you will find the best of Conor Dwyer, Ryan Lochte, another of our favorite female swimmers Missy Franklin and more. Maybe this was not the best meet for Conor and Ryan but no matter what, we always enjoy watching them race, and of course we will always support them on every step they take. And we can’t lie, we love to see them wearing their best outfits (sorry not sorry).Through these past three days, the entire meet was full of great races and course our favorite swimmers were part of some of them. And last day of finales was not the exception. The lovely Missy Franklin was part of some of the best races in Mesa Grand Prix and today she did it again, winning the Women 100 LC Backstroke with a time of 1:00.15. CONGRATULATIONS Missy!!!!!!!. The second place in this event was for Rachel Bootsma (1:00.54) and Elizabeth Pelton took the third place with a time of 1:00.84.The next event was Men 100 LC Meter Backstroke and the winner couldn't be anyone else than the just married Matt Grevers who won with a time of 54.26. I bet Annie Chandler must be so proud of him.And now is time to talk about our two favorite swimmers. They raced on 200 LC Meter IM and we have to say it was such a great and enjoyable race. Ryan Lochte Lane 4 Conor Dwyer Lane 7Conor Dwyer did a good job, even better than this morning, he placed 6th with a time of 2:05.97 improving his morning time (2:06.95).Ryan Lochte also did an amazing job finishing second with a time of  2:01.90 improving his morning time (2:03.71). And how it happened this morning all his little fans were screaming "Go Mr. Lochte" haha incredible moment for him.And it goes without saying that we are so proud of them, and no mater what, to us they always do an incredible job. We can't wait to see what them race on the next Grand Prix.Well Mesa Grand Prix is over, lots of great moments next to Conor and Ryan but don't worry the upcoming Grand Prix takes place in Charlotte, NC on May 9-12 so stay tuned for greats surprises from Conor Dwyer and of course Ryan Lochte.See you on May!Jeah!By Esmeralda Mercado & Dalia Riovalle13/04/2013(@conordwyer_mx)(@ryanlochte_mx)Follow  Conor Dwyer MexicoTwitterFacebookFollow Ryan Lochte Mexico TwitterFacebookask.fm*Pictures taken by ourselves from USA Swimming Livestream
